GENERAL CONDITIONS OF SALE
The following General Conditions of Sale (“GCS
”) regulate the offer and sale of accommodations and services in the Camping Is Arenas’s facilities.
In these GCS, the term "Parties
" shall jointly indicate the users of the web site www.campingisarenas.it ("Site
") who wish to purchase a stay at the Camping Is Arenas (“Customers
”), and Marocchi Srl, the company that owns the Site and the Camping Is Arenas campsite (“Company
”). The term "Party
" shall indicate one of the two separately.
SCOPE OF APPLICATION
These GCS apply to all sales made in the Site via the "booking online" service and reservations made by phone / email upon the receipt of the quote requested through the "Reservation" service in the Site. They may be modified by the Company at any time. Any changes and / or new conditions shall enter into force from the time of their publication in the Site.
The applicable GCS are the ones in force at the date of the reservation request or the time the order is sent via the "booking online" service.
These GCS do not regulate the sale of products and / or the provision of services by parties other than the Company that appear in the Site with links, banners, or other hypertext links. Before conducting business transactions with these parties, it is necessary to check their conditions of sale. The Company is not responsible for the provision of services and / or the sale of products by these subjects. The Company does not check and / or monitor the websites accessed through those links. Furthermore, the Company is not responsible for the contents of these websites or for any errors and / or omissions, and / or infringements of the law by these subjects. Each purchase order related to the items offered in the Site, involves the consultation and the explicit acceptance of these GCS and of the campsite rules. Customers who wish to complete their reservations in the Site, aware of civil and criminal liabilities in the event of false statements, declare that they have full legal capacity and they are 18 years old for the purposes of the Italian law. Access to the offers in the Site is for customers who are at least 18 years old only.
The types of accommodations and services that the Company offers to Customers, are those listed in the "Camping" and "Price List" sections in the Site at the date on which Customers visit the Site, as well as the portal of the "booking online" service. The images related to the campsite areas, bungalows, pitches, and other services available in the campsite are provided merely for illustrative purposes.
Available products are divided into:
BUNGALOWS: the time spent at the campsite is calculated from 3.00 pm of the day of arrival to 10.00 am of the day of departure. Should the stay be extended beyond the time of departure, an extra day shall be charged. For those who wish to arrive at the campsite before the time of delivery of the bungalow, it is allowed to enter and use the campsite services, such as bars, restaurants, etc.
In July and August, we only accept reservations for a minimum stay of 7 nights, from Saturday to Saturday.
Furthermore, the price of the bungalows does not change if the number of people arriving at the campsite is lower than the expected number of guests; it only changes if the number of people is higher. Bed linen and towels are not included in the rates, but they can be rented upon request. As also required by the campsite rules, bungalows have to be left as clean and tidy as on the day of arrival. Animals are not allowed in the bungalows (e.g. dogs, cats, etc.). At the time of check-in, Customers are required to pay a deposit of € 100.00, which shall be returned at the end of the stay, after verification of the bungalow, which must be in proper conditions. In case of any damage to the bungalow and / or objects that are inside, the deposit shall be retained in whole or in part.
PRICES AND PAYMENT
PITCHES: the time spent at the campsite is calculated from the time of arrival to 10.00 am of the day of departure. Should the stay be extended beyond the time of departure, an extra day shall be charged. There are no restrictions on the duration of the stay. The pitch booked shall be available for no more than 3 days from the expected date of arrival, after agreement with the Company. The Company does not guarantee the allocation of the pitch Customers may have requested. If Customers who have been allocated a pitch were to be absent for one or more days, the daily rate for the period of absence shall be reduced by 50% with reference to people, but not for the means of transportation to be placed in the pitch during the stay. Small pets are allowed in the pitches. For reasons of order and safety, it is not allowed to hang wires on the trees; a clotheshorse is provided upon the payment of a deposit of € 10.00, which shall be refunded when it is returned.
All prices displayed in the Site are expressed in Euro (€) and include VAT. Rates are per day and are based on the number of people indicated in the "Price List". They include the parking of a vehicle, hot showers, drinkable water, free Wi-Fi in the area next to the bar, play area, and organized activities in July and August. The rates of the "Price List" may be changed without notice, provided that the price charged to the Customer shall be the one published in the reservation summary of the "booking online" service, as well as the one indicated in the quote sent by the Company to the Customer who has applied for it.
Customers can book their stay in two different ways:
(i) By asking the Company for a customized quote via the "Contacts" service in the Site and, even without having requested the quote previously, but basing on the "Price List" available in the Site, by contacting the Company at the numbers indicated in the Site to check availability. Please note that the quote is only valid for the dates indicated by the Customer and the availability of all accommodations (bungalows and / or pitches) may change from the issuance of the quote to the actual reservation. If there is any availability, the Parties shall complete the reservation by phone or email, after paying a deposit equal to 30% of the total amount by using the banking details which the Company shall provide to the Customer. The rest shall be paid upon arrival at the campsite.
(ii) Via the "booking online" service in the Company’s "secureholiday.net" platform. In order to make the purchase, Customers have to provide their personal data and accept these GCS. Once they fill in the form with their data, a summary page will appear so that Customers can verify the accuracy of the data entered. Once they click the "next" button, a further confirmation page will be viewed. If Customers see that their data are correct, they can proceed with the payment of a deposit equal to 30% of the total amount. The rest shall be paid upon arrival at the campsite.
The deposit can be paid by credit card, bank transfer, or international bank transfer.
If Customers decide to pay by credit card, they have to enter the relevant data in the field provided, and then they have to click "Confirm your payment". At this point, a summary page will appear. If data are correct, Customers have to click "Confirm your order." At this stage, the purchase order will be recorded and a page where Customers have to provide the number of their reservation request (which has to be noted down) will appear. As soon as the Company receives the confirmation of payment, Customers will receive the final confirmation by e-mail, basing on the number of their reservation request. Customers have to print it out and bring it along upon the arrival at the campsite.
If Customers decide to pay by bank transfer, they have to enter the name of their bank and the last three numbers of their bank account in the field provided, and then they have to click "Confirm your payment". At this point, the procedure is the same as the one followed if Customers pay by credit card: a summary page will open and, after their data are checked, Customers have to click the order confirmation button. At this stage, the purchase order will be recorded and a page where Customers receive the number of their reservation request will appear, which they have to bring along upon the arrival at the campsite.
CANCELLATION OF RESERVATION
Customers who have made a reservation, but are forced to give up for any reasons, have to send a cancellation request exclusively via email to the following email address email@example.com
, or to the following fax number (+39) 0783/52103, according to the following terms:
- within 90 days from the start of the stay, the full amount paid as a deposit will be returned to the Customer, after deduction of the reservation costs (€ 25.00);
- within 45 days from the start of the stay, 50% of the amount paid as a deposit will be returned to the Customer, after deduction of the reservation costs (€ 25.00);
- after this time, the deposit shall be not be refunded.
Earlier departures and / or later arrivals compared with the terms of the GCS and the campsite rules, may cause problems and damage to the Company with regard to the management and organization of the campsite. For these reasons, the Company shall charge the Customer for the entire stay, even if it is not fully carried out.
In no event shall the Company be held liable for failure to comply with any of the obligations arising from the present GCS, in the event that the failure is caused by unforeseeable circumstances and / or force majeure causes, including but not limited to natural disasters, terrorist attacks, malfunctions, and / or power blackout.
These GCS represent the entirety of the agreement between the Company and the Customer, with regard to sales made by and / or via the Site.
The GCS and the contractual relationship between the Company and the Customer are regulated by the Italian law. For any dispute regarding the application, execution, and interpretation of these GCS and the contract with the Customer, the court of jurisdiction is where Customers reside or are domiciled.
